Just to clarify, no I wasn't asking rhetorical questions. Your scenario with Jason's music is exactly what I was thinking of.

By "cross promotion" I was thinking something along the lines of a high school band album featuring previously unpublished new compositions. It would promote the band as well as the composer.

Thanks for your reply.

Stengel99,

Thanks for commenting. I'm not sure exactly what the context was of of E2, I'd have to go back and check it out again. I think you're right about using created materials in any context. As musicians we certainly have an "edge" in that department.

I've had a number of people ask me about using their materials for our "intro", "outtro" music for our podcast and to be honest, I'm pretty happy with the "Penguin" that we are using from Jason Davis. I love his music and he and I are very good friends.

James Frankel and Owen Bradley use compositions that they have made from within their classes in various podcasts and other ways on their sites and podcasting. It is quite interesting and no doubt effective for them.

Regardless, of whay you decide to use for your website, podcast, or online venue, you still have to receive permission to use the materials in such a dispersive free way. If you use someone's unpublished work, your friend the composers, or even your own works, you have to obtain someones permission (even if it's your own) to do so and you should state it on whaterver medium you are using... Although, I'm for a revision and re-vamping of the copyright policy for a "fairer" fair-use section, I have personally decided to try to remain with the legalities of what is allowed and not within the "ethicalities" of what I might believe to be fair.

I do think that you might be surprised as to the answers you will get regarding using "non-mainstream-popular" music with regard to a copyrighted purposes. Don't be afraid to ask! Just because something is marked as copyrighted, it doesn't mean "hands" off", it means "ask for permission". You'll be surprised by the answers you get.

On a related note, I've been asked to include others "promotional materials" at the begining of our podcast in a cross-promotional way but so far I've stayed away from such type of advertising. I'm not against it, but I have been trying to not clutter up mustech.net with too much advertising. Mustech.net does take alot of time and resources to keep operating and I do appreciate when people dontate money to us or simply click on the non-obtrusive links that I do have. I may be adding a little more paid spaces soon.

I'm also working on an exclusive free opportunity(ies) for the ME bloggers that will literally be the first of it's kind offered from the "industry" for free to the ME bloggers. Stay tuned!

I'm not sure if answered your questions or they were rhetorical, but regardless the're great ides!... For what it's worth :)

OK this might be a shameless promotion but... If any of you need music, I bet my students would be happy to send you some. You can here a sample of student music on the Greenwich High School podcast at:

Hi again, guys. Just a thought related to something Joe mentioned on E2 regarding the fair use of copyrighted material for promotional material like web sites. Rather than using copyrighted material, why not consider something composed and produced internally? Wouldn't it even be more effective to promote the program by using an original work by the music teacher, a commissioned work, or even a student composition? I'll bet you might even be able to find an unpublished composer who would be willing to let you use his or her work for free with some sort of credit or cross-promotion?
